Employment Rights Act and Statutory Sick Pay

From April 2026, Statutory Sick Pay (SSP) will undergo significant reform due to the Employment Rights Act.

SSP will become payable from the first day of absence, and the earnings threshold for eligibility will be removed. These changes mean that all social care and support staff—regardless of contracted hours—may become eligible for SSP.

To support providers in understanding the implications, the Care Provider Alliance will host a webinar with colleagues from the Department for Work and Pensions (DWP), the DHSC Fair Pay Agreement Team and Anthony Collins Solicitors.
